Q Anderson was seriously injured in an accident. Anderson's daughter called the doctor and told her to "...give my dad the best medical care and I will personally guarantee payment!" Doctor complied, but Anderson passed away the next night. Daughter refuses to honor the payment. Will the daughter be held responsible for her father's debts? Not a trick question, this is the chapter on Discharge of Contracts; from a previous chapter's logic on when you need a writing how would you decide the case?

This is a clear case of contract which is based on words or on implied communication (Liuzzo & Bonnice, 2016). The doctor had given the best which the doctor could. The doctor had also done for Anderson what the doctor had committed to do and what the doctor had been requested to do by Anderson’s daughter. The doctor did everything which the doctor could but still did not receive what the doctor had been entitled to legally as well as ethically. It was not the fault of the doctor that Anderson had passed away the next night after the treatment had been done by the doctor to give the best possible care to Anderson.
